Greg – Proxy Treasurer Report (Info sent by Carrie on 9/26/10)

We had two expenditures for the month of August.
8/30 $300: State Farm Insurance for the pier (annul premium)
8/30 $550: Linowes/Blocher LLP (attorneys for pier project)
Balance remaining in Operating account $2074.51
Balance remaining in Pier Fund account $3188.39

Dues are due. Bills will be forthcoming. $100 Annual or $50 every 6 months.

Pier Committee—Greg Report

Went to county. They were agreeable to let us remove the note form the plat by submitting an amended subdivision agreement plat. Then we will file a non-conforming use permit, proving that the pier has been there and used consistently for a 30 year period. We have photos from 1952 which helps. Then we can improve the pier and expand it up to 30% of the entire area that the pier takes, including the wet areas.

To prove non-conforming, we can get affidavits, aerial photos, land records, tax assessments, covenants from 1982 which states that the pier was there.

 

We will need to hang on to the attorneys for a while. But it’s a positive thing and its still going to be a while. but they knew who Ben was, and we were speaking with the women in charge of planning and zoning. And they gave him the names of the people we need to talk to for the next steps.

 

One thing they did say, is that we can go ahead and get approval from the MDE, Maryland Department of the Environment. And when I talked to them in January, I sent them my drawings, and they said “we’re fine if the county will let you do it.”

Okay.

 

now, Bylaws and Covenants.

 

John L – I went through all the minutes and did my best to incorporate all the points that people wanted. But there was very little feedback.

Let’s kick it off with common areas.

-Vote need to define common areas – then supporting text will refer to the original definition. Defined as the pier, the gravel road, the community sign, and this does include the shrubs and or bushes surrounding the sign. It does not include any utilities, b/c the county and utilities will need access to it via their easements.

 

#6 we will change to the gazeebo and the little Shed, and the recreation area.

#7 the no trespassing signs.

 

John L- I forward a motion to vote on what we are going to plant there at the next meeting.

 

Greg W – I second it.

Vote – Everyone said yes on voting next meeting on the shrubs and what to plant around the sign.

Let’s define what a quorum is. And just for the record, the minutes say that it was agreed that it already set at 8.

 

So what is a quorum.

Don, Anita, Jo – I like 6.

 

Joe Z – I thought we agreed on a number at another meeting.

 

Motion on floor to define 8 as quorum.

John L- Second

Vote – All against…. Except one.

 

Motion on Floor to define 6 as quorum. Seconded.

Vote – All in favor…. Except one.

 

Motion and second of defining Majority as 10 out of 15 house holds, including proxies.

Vote – All in favor.

The majority is defined as 10 out of 15 households, proxies will count as votes.

 

Motion and Second to set Meeting Times 7 – 9 pm or as needed.

Vote – Time approved as 7-9 pm or as needed.

 

Motion and Second for the meeting day to be approved as 1 st Tuesday of the month, or as needed.

Vote- All in favor for Time and Dates of meeting are 1st Tuesday from 7-9 of each month.

 

Motion and Second to set Month of Jun and election of officers, and audit shall be made in conjunction with June meeting.

Vote- All in favor

 

 

Motion and second to allow that Special meetings may be requested at any time in telephone, written or email request to officers.

Vote- All in FAVOR.

 

Motion and second to ADD treasurer to the list of officers in bylaws and covenants,

Vote- All in FAVOR.

 

 

Motion and second that any decision affecting common property would require majority vote, including proxies.

Vote- All in FAVOR

 

Motion that states that In order to Execute a vote, at least 10 members including either President or Vice President, must be present.

Vote – ALL in FAVOR

 

Motion and second stating that the Introduction of any new bylaw, must first pass a quorum, 6, and then pass a majority vote.

Vote : ALL in FAVOR

 

#8 Strike Partnership agreement to RHHA (doesn’t apply to us)

 

Motion and second to vote on……

#9 Annual Meeting with Majority to make amendments to Bylaws or to elect officers.

VOTE – ALL in FAVOR

 

Motion and second to vote on……

#10- Each RHHA member and board of officers shall have ONE vote in all matters.

VOTE – All in Favor

 

Motion and second to vote on……

#11 Proxies can include email, written, phone conversation

VOTE – ALL in Favor.

 

Motion and second to vote on……

#12 – Membership to RHHA – Every owner of lot shall be a member to the Association. More verbage included in written docs.

Vote – ALL in FAVOR

 

Motion and second to vote on……

#13 – Use of email as official form of RHHA communication, which may include proxy votes.

Vote – ALL in FAVOR.

 

 

John L- You guys need to give me some feedback on the detail of how the common areas should be governed. Who is on the pier, when, if there is a party with 50 people, if there is smoking on the pier.

I think this is going to just as, if not more, contentious as everything else.

But this is for the common areas. nothing else is going to be governed. Only the common areas.

 

John L- I put forward a motion to put into VOTE at the next meeting article 4,5,6,7,8,9,10 and 11 and to finalize the entire RHHA Covenants and Bylaws.

Please send me email….the little text in there is just for suggestion. You guys let me know what you think about them. You have to think about little kids, pets etc. You have to think about legal liability. Little kids need to wear life vests. Little kids need to be supervised at all times. If something happens down there, it’s coming back the homeowners association. So this stuff is all important.
