Minutes (Tuesday March 15, 2011)
Quorum was not able to be established because we only had 5 RHHA members present; need 6 to have a quorum
Minutes from the last RHHA meeting was accepted (motion and second passed)
n RHHA Treasurer reported that there was a balance of $2,874.52 in the RHHA Checking account
n RHAA Treasurer reported that there was a balance of $1,539.62 in the Pier fund
n RHHA Treasurer reported that there was a bill from the attorney who is currently giving us consultation on the Pier reconstruction project for $650.00 (not paid yet)
n RHHA Treasurer reported that it is time to file our RHHA 2010 taxes. An tax filing appointment is in place for next Tuesday to meet with the CPA. Form 1120H (dues form) and Personal Property Tax form will be required.
n Bills have been prepared for the RHHA homeowners who still owe. RHHA President (Don) proposed to send them out via US Mail paid postage versus leaving them on the door. Motion passed and seconded. RHHA Vice President note, since the meeting was unable to establish a quorum, all those NOT IN FAVOR of using RHHA funds, please email your vote to the RHHA Board members.
n RHHA Treasurer identified that she did not have the address of Mike Gilepsie (house next to John Latuperissa and John/Tammi Messino) . We need to get their address to send the RHHA annual dues bill (John Latuperissa take lead on this)
n Status on pier from Don: first of the year (2011), Don corresponded via USPS mail to our attorneys numerous times with no success but after corresponding with Ben’s boss, he received a prompt reply from the law firm. Don told the attorneys that he believed that RHHA did not need to pay to have a new pier engineering plat drawn up. The attorney then stated that it might be in our best interest to have a certified engineer redraw our Rhode Harbor pier plat up. Don identified that the most recent plat was drawn in 1981. Don had spoken with a commercial engineer (McCrone:http://www.mccrone-inc.com/) to redraw our plat and stated it will cost ½ of what we are paying our current attorney. Don stated we will not need an attorney anymore if we choose to move our pier project to the engineer (McCrone Survey and Engineering Firm). So everything is in on hold until we meet with McCrone Inc. This will require a vote, so please be on the lookout from our RHHA Secretary or myself (RHHA VP John Latuperissa) for an email that will require your YES or NO vote.
n Don will be speaking wth McCrone, Wednesday the 16th of March, to discuss meeting date and particulars.
n Don discussed potential options on the future size of our pier, in terms of how many slips we may or may not be authorized to construct. The crux will be how the county measures the pier across the river. If they measure straight across, that will be bad for us allowing for only the minimum amount of slips, but if they measure the way the pier is currently and has always been oriented, then we should be able to build a large number of piers.
n Don (RHHA President) stated he will be gone on vacation the 29th of March and forward two weeks.
n Propose May 14th (Saturday) for another RHHA community yard sale
n Jo presented a formal RHHA Community Sign and Tree/Flower project that included custom drawn CAD renditions of our current planter and sign. In it, her proposal includes
o Removing existing trees behind sign planter
o Replace above trees with Star Magnolia Trees (send out via email for a vote)
o Plant flowering perennials (Tiger Lillies) (send out via email for a vote)
o Keep existing border plant
o Regravel as needed
o Need to ensure that we purchase new trees that are high enough to breach the highest point of the sign.
o Decision was made to powerwash the existing RHHA community sign, and if it deteriorates from the power wash, we will send out options to replace the sign via email for a vote. Don stated that he has a powerwasher that can be used to powerwash the current sign.
n Discussion had taken place on the possibility of replacing the current sign. Joe Z. brought up the fact that we may need a county permit to fix, upgrade or completely replace the sign. Another point was brought forward that we may be better off looking for volunteers within the RHHA community to use their own tools and supplies to build a new sign. n The last part of the meeting consisted of finishing the bylaws on the governance of the Pier and other parts of the RHHA Community Property and are listed as follows. Please note that these will require a final vote. Lastly, RHHA Community Property is defined in the Covenants and Bylaws (Pier, access road, sign, signage area, etc.)
o No fireworks allowed or to be used on in anyway, on RHHA Community Property
o No firearms or ammunition allowed on RHHA Community Property
o Alcohol consumption in accordance with (IAW) local, state and federal laws.
o Noise. All music, construction work, or any other loud noises that will disturb the surrounding neighbors and/or neighborhood must cease between 2200 (10:00pm) to 0700 (7:00am).
o Hours of operation. RHHA members are allowed to use the common property 24 hours a day, seven days a week, however, they are expected to keep noise to a minimum between 2200 to 0700.
o Trash. All trash generated by RHHA homeowners on common property must be taken off RHHA common property the same day with no exceptions. Fines will be levied for repeat offenders and notice. Trash is not allowed to be stored on RHHA pier docked boats.
o Fires. No open fires of any kind (e.g., grill, boat grill, etc.) will be allowed on RHHA common property; especially those boats or water vessels docked to the RHHA Pier.
o Sewage. No overboat discharge of sewage material while docked to the RHHA Pier. No urination or defecation on RHHA common property. Fines will be levied by RHHA for offenders and all associated costs of cleanup will be billed directly to RHHA homeowner.
o Refueling off RHHA Pier. Explicitly forbidden
o Fishing and Crabbing. RHHA homeowners must immediately cleanup all fishing tackle, bait, fishing lines, and any associated trash upon finishing or leaving RHHA common property
o Fines. RHHA has the right to levy fines against RHHA homeowners that are in violation of the bylaws and convenants outlined herein. RHHA will require a majority vote to levy a fine against an RHHA homeowner.
