2009 Proposed Bylaws and Covenants – Early version

NOTE: Attached are beginnings of the bylaws and covenants.  As stated at meeting they are all together, will check with Jackie about another committee meeting this month, so we can get something to put before the membership for a vote. Still have a lot to cover.)
 

Proposed Covenants & Bylaws of Rhode Harbor Homeowners Assn.

 

  1. A general membership meeting will be held annually in June or whenever the Board of

Directors deem it necessary.

 

  1. All elected Officers (President, Vice President, Secretary, Treasurer) and Board of Director members (3), shall serve a term of one year, to expire in June of each year, without any term limits.

 

  1. An annual dues (amount decided by membership vote each year), will be due in ______ of each year.

 

  1. No owner of any parcel in Rhode Harbor shall acquire by reason of his ownership, any right to erect duck, goose or other fowl pits or blinds thereon.

 

  1. All owners of Rhode Harbor will abide by the Anne Arundel County’s Animal Control Laws in regard to their pets.When you walk your pet, it is your responsibility to clean up after it.

 

  1. The Community Pier and Common Area is only for the use of the property owners of Rhode Harbor, their family and guests.

 

  1. The property owner assumes any risk of the use of the pier or slips for himself, family members and/or guests.The Association and Board of Directors shall be held harmless

in the event of an accident or personal injury.

 

  1. No vessel moored shall be used as a residence.

 

  1. All vessels must be the property of Rhode Harbor homeowners, with no more than one

vessel per family.

 

  1. If space allows, a Rhode Harbor guest may tie up on the pier during daylight hours only.

A guest is not allowed to tie up in another property owner’s slip.

 

  1. A separate assessment will be levied for the community pier upkeep each year, to be set

by the Executive Board and Pier Committee.  This assessment will be levied on slip holders only.

 

  1. After any use of the common area, owners are required to clean up all trash generated and dispose of it immediately.

 

  1. This includes but is not limited to crabbing from the pier—you must remove all crabbing lines and baits, and dispose of them properly.

 

  1. Persons using crab traps and pots must abide by Anne Arundel County regulations.

 

  1. There is to be no parking on the access road.The access road is for loading and unloading only.

  1. There is to be no driving or parking past the County sewer access and no parking on the

grass.  Use only the gravel road.

 

  1. Parking on the street and particularly the circle should be done in parallel style and not

vertically so as not to block another driveway access or hinder mail delivery.

 

  1. The Maintenance Committee shall be responsible for cleaning and weeding the entrance sign site and cutting the grass at the common area and keeping the out building in good repair.

 

  1. The Pier Committee shall be responsible for keeping the pier in good repair.

 

  1. In addition to the covenants, the following specific easements apply to the Rhode Harbor

Subdivision as indicated on the record plat—

 

  1. A trapezoidal shaped easement beginning at the end of Rhode Harbor Road and

continuing to Whitemarsh Creek titled “20’ storm drain easement”.  Said parcel shall

also be used by the Rhode Harbor property owners for ingress to and egress from the

recreation/common area.

 

  1. A triangular shaped easement located on the southern portion of Lot 9, which is used

for the community sign.

 

  1. All of the covenants and restrictions contained herein shall be in perpetuity until that time when the membership of Rhode Harbor Homeowners Association sees fit to cancel, amend or introduce new regulations and shall have them ratified by a 2/3 majority vote of the members.

 

  1. If any provision of the covenants herein shall be held invalid, the remainder of these covenants and restrictions, other than those as to which it is held invalid, shall not be affected thereby.
