There is quite a bit that was said that could not be recorded, therefore, consider the minutes as a bit of short hand with some exclusions. Thanks, Greg.)<\/p>\n<p>&nbsp;<\/p>\n<p>Initial RHHA Meeting to discuss the creation of the RHHA, History, Existing Structure, Existing accounts, and to plan for the future, changes, and next meeting, with a time for Q&amp;A from all.\u00a0 5\/17\/2009\u00a0 3pm at 3925 Rhode Harbor Road<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>In Attendance<\/p>\n<p>Janice Fyanes and Joanne Kowalke<\/p>\n<p>Anita and Joe Herring<\/p>\n<p>Don and Rita Dunbar<\/p>\n<p>Johnny and Tammy Messineo<\/p>\n<p>Joe and Carrie Zambrana<\/p>\n<p>Mike Gillespie<\/p>\n<p>Mary D.<\/p>\n<p>Ray and Jackie Pearl<\/p>\n<p>Carolyn and Ken Polglase<\/p>\n<p>Bob Mongold<\/p>\n<p>Greg Whitesell<\/p>\n<p>&nbsp;<\/p>\n<p>Intro and welcome by Greg Whitesell<\/p>\n<p>&nbsp;<\/p>\n<p>Carrie Z- History and research.\u00a0 Concerns about new elections\u2026move forward etc.<\/p>\n<p>Q and A to follow.<\/p>\n<p>&nbsp;<\/p>\n<p>1982 community created and filed with the county.\u00a0 1983 covenants filed with county.\u00a0 20 year\u2026now can be rewritten. They have never been enforced and are not being\u00a0 enforced.\u00a0 Copies to be posted on the web site for all to see. Intent was that community would take over.\u00a0 Control the pier.\u00a0 Now entrusted to the county\u2026 solely for eh purpose of the community,\u00a0 not outsiders.<\/p>\n<p>&nbsp;<\/p>\n<p>Info about the pier by Joe Later has gotten estimates on the pier.<\/p>\n<p>&nbsp;<\/p>\n<p>Carrie Zambrana- Financial report &#8211; at 2000,\u00a0 community agreed to move foward at the time with the association.\u00a0 $200 by owner.\u00a0 Interest of about $100 has been made. It has been up, and then went down with the rest of the market.\u00a0 No costs have been incurred to date by the RHHA.\u00a0 No documents files as of yet with the county.<\/p>\n<p>&nbsp;<\/p>\n<p>Info found\u2014Estimate on the pier.\u00a0 Talked to County about the pier.\u00a0 County is not interested in the pier.\u00a0 They don\u2019t want it.\u00a0 They want to give it back to us.<\/p>\n<p>&nbsp;<\/p>\n<p>Anita Herring &#8211;\u00a0 Covenants null and void?\u00a0 Jumping the gun?\u00a0\u00a0 Yes, they do want to give it back to us.\u00a0\u00a0 Don Dunbar\u2026.Vice President.\u00a0 Incorporated?\u00a0 It has to be incorporated.<\/p>\n<p>Carrie Zambrana\u2014The covenants have been on file\u2026but after 20 years they can be written, and can be written now.\u00a0 But current covenants on file with the county are in effect in perpetuity until they are replaced with something else.\u00a0 No one has been enforcing them and no one will enforce them as they are written.\u00a0 They include things such as no boats in yards and no swimming pools.<\/p>\n<p>&nbsp;<\/p>\n<p>Don Dunbar\u2026.we can now start from scratch.<\/p>\n<p>&nbsp;<\/p>\n<p>Anita Herring\u2013 Incorporate with Lawyer?<\/p>\n<p>Carrie Zambrana.=\u00a0 It will increase expenses.<\/p>\n<p>Any one can file the paperwork.<\/p>\n<p>Bob Mongold- $35 form the state. It\u2019s not that hard or that expensive.<\/p>\n<p>Anita- Person from the county will help us to form it.\u00a0 Anita has experience.\u00a0\u00a0 You can buy the papers and the forms and then fill it out.\u00a0 If it wrong, the county will tell you.\u00a0 County can assign someone to help us get it together without cost.<\/p>\n<p>Greg Whitesell- Maybe we should get as far along in the process as possible on our own, then together decide whether or not we want a lawyer to help us by looking over it and possibly filing it for us.<\/p>\n<p>&nbsp;<\/p>\n<p>Mary D. \u2013 Covenants are perpetual, but can be changed.\u00a0\u00a0 Should we assume responsibility,\u00a0 we need to make sure that the pier and everything is insured.<\/p>\n<p>&nbsp;<\/p>\n<p>Anita Herring- How can Young\u2019s covenants still be in force?<\/p>\n<p>Carrie Zambrana- Some are absolutely obsolete.\u00a0\u00a0 Others are still on file.\u00a0 But NEW covenants can be written completely.<\/p>\n<p>&nbsp;<\/p>\n<p>Q&amp;A\u2026.concerns about being fair.\u00a0 Some people have their own piers.\u00a0 Some don\u2019t want to use the pier.<\/p>\n<p>Don Dunbar. \u2013Discussed pricing between pier and community. We need the community association, and then something like a \u201cdockmaster.\u201d\u00a0 Fees for the pier could be raised separately by those interested in the pier and slips.<\/p>\n<p>Greg Whitesell- Discussed liability costs for State Farm $720\u00a0 Liability only. Don\u2019t want to cover for anything other than liability. Marc Carella at state farm quoted an estimate of $720 per year with $1million in coverage and a clause to protect the HA officers.<\/p>\n<p>Carrie\/Ray discuss the other pier with a boat-house. It\u2019s not our property and we don\u2019t want to extend our liability.<\/p>\n<p>&nbsp;<\/p>\n<p>Tammy Messineo \u2013 Why an do we need a Homeowner\u2019s Association at all? We don\u2019t want people up in other\u2019s business?\u00a0 Why can\u2019t we not just have a pier association?\u00a0 Johnny Messineo &#8211; I\u2019m not interested in the pier at all.<\/p>\n<p>&nbsp;<\/p>\n<p>Don Dunbar \u2013 I am. I know that having access to the water and having a pier increases the value of my house.\u00a0 When I go to sell it, that is going to help.<\/p>\n<p>&nbsp;<\/p>\n<p>Joanne, Don and Ray, Greg\u2014Discussing pier design.\u00a0 Total length can be extended to a maximum of 25% across the creek.\u00a0 We need to redesign the pier.\u00a0\u00a0 There are 10 foot stand off rules to the property lines.\u00a0\u00a0 Tax assessment.\u00a0 Tax assessment on the property according to the State and the county is Zero and will always be zero.\u00a0 It is set aside as community recreation area and is has been assigned no value.<\/p>\n<p>&nbsp;<\/p>\n<p>Ken Polglase- It\u2019s my understanding that the pier is listed with the county as a Fishing pier only????\u00a0\u00a0 We aren\u2019t even supposed to have any boats down there.<\/p>\n<p>Carrie Zambrana &#8211; No. It is listed as a fishing and crabbing pier.\u00a0 But not a problem. There have always been boats down there.<\/p>\n<p>Don Dunbar \u2013 What pier doesn\u2019t have boats tied up to them?\u00a0 That\u2019s not going to be a problem. The youngs always had their boat down there.<\/p>\n<p>&nbsp;<\/p>\n<p>Joann \u2013 I\u2019m confused about the original property being developed? How is it that it has just been developed?<\/p>\n<p>Carrie Zambrana \u2013 The last house was recently built.\u00a0 In 2002 the property where this house sits was subdivided allowing for the house behind this one to be build.\u00a0 The Young\u2019s owned all the property around here and then parceled it off, selling lots to others to be built or building some of the houses themselves.<\/p>\n<p>&nbsp;<\/p>\n<p>Carrie Zambrana- On keeping costs down. Thus far we have been able to keep costs down associated with maintaining the common areas. People have volunteered such as Jackie Pearl and Joe on the corner to move the grass down by the pier.\u00a0 Greg has been paying for the electric down at the pier since he moved in in 2002.\u00a0Johnny and Tammy have been maintaining the area around the sign on the corner at the entrance to the neighborhood. Thank you all for your contributions. And we thank you if you continue.<\/p>\n<p>&nbsp;<\/p>\n<p>Carrie Zambrana,\u00a0 Road to Water Pump station\u2026..call county and have them do it. The county will come out and put rock on the road leading to the pump station.<\/p>\n<p>Anita Herring- The county is great about coming out to fix any problems with the roads.<\/p>\n<p>&nbsp;<\/p>\n<p>Ray Pearl&#8212;I have water problems.\u00a0 County won\u2019t help.\u00a0 I have all sorts of runoff coming from the backyards all around me and the county says that it is the builder\u2019s problem. So I called Steve Young and he said it is the county.\u00a0 So I went out there and did what I could myself and put a 12 inch pipe in my yard to try to fix it.\u00a0 But now, one of the grates out by the street doesn\u2019t have any dirt under it to support it.<\/p>\n<p>Anita Herring\u2026.Call county and tell them that septic is running out of the pipes.\u00a0 It\u2019s magic word.\u00a0 They be right out here.\u00a0 It is the county\u2019s responsibility to fix that stuff.<\/p>\n<p>&nbsp;<\/p>\n<p>Tammy \u2013 I still don\u2019t understand, why we need a homeowner\u2019s association at all. I don\u2019t want people telling me what I can do with my property.<\/p>\n<p>Johnny- I don\u2019t mind helping.\u00a0 But I don\u2019t need or want to pay for a slip.<\/p>\n<p>&nbsp;<\/p>\n<p>Don Dunbar &#8211; We need to have a Homeowner\u2019s Association, then we need to have the pier fall under the homeowner\u2019s association.<\/p>\n<p>Ray Pearl \u2013 It doesn\u2019t matter what you call it.\u00a0 It is going to be the same thing.<\/p>\n<p>Don Dunbar- Out in Manassas, (our son?) you can\u2019t even walk out the door backwards there.\u00a0 We aren\u2019t going to have a bunch of rules like that.<\/p>\n<p>Ken Polglase &#8211; ?????<\/p>\n<p>Jackie &#8211;\u00a0 You can have a Pier Assoc without having a HA.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>Anita Herring &#8211; On costs for the pier call&#8211;Capital marina?<\/p>\n<p>&nbsp;<\/p>\n<p>Mary D.\u2026.I want to make sure that the moment we take control of the pier and it is transferred to us that we\u00a0 have insurance before we assume responsibility.\u00a0 I can\u2019t even tell you but I had roommates that seemed to break everything that they touched.\u00a0 They hurt themselves and I feel lucky that they haven\u2019t tried to sure me. At least not yet.\u00a0 I just don\u2019t want anything like that to happen.<\/p>\n<p>&nbsp;<\/p>\n<p>Greg Whitesell \u2013 looking forward, do we want to continue forming this under the current officers of go ahead and move to elect new ones.<\/p>\n<p>Tammy Messineo &#8211;\u00a0 yes\u2026.new.<\/p>\n<p>Greg Whitesell \u2013 How do we want to do this.\u00a0 When.\u00a0 Who is willing.\u00a0 Ask each member present whether or not they would be willing to hold office and what they would be willing to do.\u00a0 We will make list now. Send out letter and allow for others to enter their names for nomination and election who are not here today.\u00a0 Then the next time that we meet, we will have nominations from the floor and hold elections.<\/p>\n<p>&nbsp;<\/p>\n<p>Current List of Willing: (open for others to join)<\/p>\n<p>Greg Whitesell- yes as support but not leadership- yes Secretary<\/p>\n<p>Carrie Zambrana- as Treasurer\u00a0 (yes I have access to all account now)<\/p>\n<p>Joe Zambrana- yes willing as President<\/p>\n<p>Don Dunbar- yes, I\u2019ll take\u00a0 any position<\/p>\n<p>Tammy Messineo- not president, but yes any position VP or below<\/p>\n<p>Jackie Pearl \u2013 yes. Not sure what, but I am willing to help.<\/p>\n<p>Anita Herring \u2013 Yes, not sure what position right now,\u00a0 maybe VP or below\u00a0 (I want to be on the board of directors)<\/p>\n<p>&nbsp;<\/p>\n<p>Don Dunbar- We will also need to have committees.<\/p>\n<p>Ray Pearl- I am willing to help out with maintenance and things like that.<\/p>\n<p>Johnny Messineo- I\u2019m willing to help out any way I can.<\/p>\n<p>&nbsp;<\/p>\n<p>Set agenda for Next Meeting:<\/p>\n<ul>\n<li>$35 kit yes &#8211; to file the paper-EVAL<\/li>\n<\/ul>\n<p>(It is agreed that we will purchase the forms needed to file the papers with the county and asses any costs associated and evaluate those forms to begin the process.)<\/p>\n<ul>\n<li>YES&#8212;make pier better, it is agreed that we should do anything now that we can to make the pier safer, stronger and functional. Jackie Pearl will speak with Marc Carella at State Farm to find out what needs to be done to pier to get an insurance policy on the pier.<\/li>\n<li>Evaluate the shed and gazebo \u2013 It is agreed that we need to asses the gazebo and shed to see how safe they are and what repairs or replacements should be done.<\/li>\n<li>Elections\u2014Nominations and Elections will take place at the next meeting on Tuesday, June 23, at 7 PM at Rita and Don Dunbar\u2019s house. Meeting in June for Nominations from floor, and floor vote.<\/li>\n<li>In between now and next meeting a letter will be sent out reporting on this meeting, announcing the upcoming elections and call for nominations, and announcing the meeting on the 23<sup>rd<\/sup> of June.
