{"id":142,"date":"2010-05-25T19:57:01","date_gmt":"2010-05-25T19:57:01","guid":{"rendered":"https:\/\/rhodeharbor.com\/?p=142"},"modified":"2015-08-19T19:57:39","modified_gmt":"2015-08-19T19:57:39","slug":"meeting-minutes-from-10th-rhha-meeting-5252010","status":"publish","type":"post","link":"https:\/\/rhodeharbor.com\/?p=142","title":{"rendered":"Meeting Minutes from 10th RHHA Meeting \u2013 5\/25\/2010"},"content":{"rendered":"<p>5\/25\/10<\/p>\n<p><!--more--><\/p>\n<p>In attendance:<\/p>\n<p>Joe Redzensky<\/p>\n<p>Anita &amp; Joe Herring<\/p>\n<p>Mike Scruggs<\/p>\n<p>Beth &amp; Greg Whitesell<\/p>\n<p>Don &amp; Rita Dunbar<\/p>\n<p>Bob &amp; Kathy Mongold<\/p>\n<p>Ray (kind of)<\/p>\n<p>Joe Zambrana<\/p>\n<p>&nbsp;<\/p>\n<p>Don- Accept minutes: Minutes into Record.<\/p>\n<p>Carrie not here for Tres Report. i will bring up something in a few minutes regarding that.<\/p>\n<p>Last thing we will do is bys and covs.<\/p>\n<p>&nbsp;<\/p>\n<p>yard Sale had 5 particpate:<\/p>\n<p>&nbsp;<\/p>\n<p>Ken &amp; Carolyn<\/p>\n<p>Don and Rita<\/p>\n<p>Beth and Greg Whitesell<\/p>\n<p>Joe Redzensky<\/p>\n<p>Joe Zambrana<\/p>\n<p>&nbsp;<\/p>\n<p>70-90 dollars for advertising, Don will get final figure so we can reimburse Mary.<\/p>\n<p>&nbsp;<\/p>\n<p>Yard sale went well \u2013 signs looked good<\/p>\n<p>Don said: Nice thing besides money is we cleaned out some junk out of the house<\/p>\n<p>everybody got out and talked to everyone! nice social event for the neighborhood<\/p>\n<p>Good gathering \u2013 almost like having a block party<\/p>\n<p>Most people said something about seeing the signs \u2013 Greg said one person heard about it through the adds in the Newspaper.<\/p>\n<p>Don said he would like to do another yard sale in a month if anyone is interested.<\/p>\n<p>&nbsp;<\/p>\n<p>Last year on 6\/23\/2009 was first meeting \u2013 this June 23 will be anniversary \u2013 need to elect new officers<\/p>\n<p>We could continue with the same officers if not opposition or if nobody else wants to run Nominating committee \u2013 have a couple of people that are not normally on the committee<\/p>\n<p>can be 2 people \u2013 2 or 3<\/p>\n<p>Committee can nominate anybody they want<\/p>\n<p>Volunteer for nominating committee: (Mike Scruggs and one other)<\/p>\n<p>Need to talk to current officer and anybody who wants to be an officer who is not can talk to the committee<\/p>\n<p>Nominating committee will report next month \u2013 nominees from the floor next month.<\/p>\n<p>&nbsp;<\/p>\n<p>Biggest things:<\/p>\n<p>Pier: pier committee has acquired an attorney (Greg, Joe, Don) talked to someone a week ago \u2013 attorney is in Annapolis and highly recommended by guy who owns Rhode River Marina<\/p>\n<p>concern about making a commitment without having a vote \u2013 feeling from other people is only way we would get anywhere is with an attorney<\/p>\n<p>Charles Schaller and Benjamin Wechsler<\/p>\n<p>Talked to them for a little over an hour \u2013 charges by the hour in 10 minute increments<\/p>\n<p>Charles knew his stuff \u2013 had some concerns<\/p>\n<p>Go to courthouse to get photos from 1971 on and try to get copies of deeds to find out why it was put on that there would be no boats put on the pier \u2013 county took pier and did not want liability \u2013 until Charlie finds out why that is on there \u2013 he will do best for us \u2013 but wants that to be found out before he can do anything. He will get us through zoning \u2013 we still need to go through permits\/special<\/p>\n<p>14, 669 square feet \u2013 less than half of the 30,000 needed for community pier.<\/p>\n<p>&nbsp;<\/p>\n<p>Joe and Greg went to talk to the office of zoning at the county \u2013 her opinion was that it had the note because we did not have the 30K square feet that is needed<\/p>\n<p>Strictly fishing because not enough land to support boats<\/p>\n<p>&nbsp;<\/p>\n<p>Earl Young had same problem? Him giving everyone slips was bogus.<\/p>\n<p>&nbsp;<\/p>\n<p>Greg: From trip to courthouse and zoning they did not find anything that will help us at all yet.<\/p>\n<p>Has appointment on Tuesday to look at the aerial photographs that will hopefully show that the pier had piling slips as far back as 70s \u2013 did not find anything in covenants that is on file with the county<\/p>\n<p>&nbsp;<\/p>\n<p>Did not find anything that would hurt us \u2013 except the county workers!<\/p>\n<p>&nbsp;<\/p>\n<p>Few different vintage pilings out on the pier<\/p>\n<p>&nbsp;<\/p>\n<p>Greg is hoping the slip pilings will predate the development of community and subdivision<\/p>\n<p>&nbsp;<\/p>\n<p>Without attorney we will not get anything, but still not guarenteed to get anything<\/p>\n<p>&nbsp;<\/p>\n<p>Charlie will go to county and zoning and knew all of the names of people to go to, will have meeting with them and see what they can do. Note \u2013 no boat slips on plaque<\/p>\n<p>Court order in 1985 he was concerned about \u2013 unknowns is what he is afraid of \u2013 Greg and Joe said that they looked into that and it does not mean anything<\/p>\n<p>Will be talking to the Rhode River Keeper to see if he would have any objections \u2013 an election year therefore you need to use political county \u2013 nobody will sponsor a project if anybody would say anything against.<\/p>\n<p>&nbsp;<\/p>\n<p>Campaign for support can backfire \u2013 Mike S. \u2013 what burden of adversement would this draw if any<\/p>\n<p>Will the river keeper have a way to find out we are doing this if nobody tells him \u2013 he probably has access to this information \u2013 we should definitely be proactive and contact him before he finds out and possibly has an objection<\/p>\n<p>Need to tell him we want to improve pier and make bigger<\/p>\n<p>&nbsp;<\/p>\n<p>Lawyers say talk to everyone and he wants us to get a letter from landowner behind Ray \u2013 we will never find her!<\/p>\n<p>Lawyers said if we want to do this and someone is upset about it, we are in trouble.<\/p>\n<p>&nbsp;<\/p>\n<p>Story about Darnestown \u2013 gun club \u2013 mcmansions not liking the noise \u2013 club won because it had been since 1936 \u2013 they just moved here. Used to use lead shot \u2013 river keeper went to EPA \u2013 10 million to clean stream and closed down.<\/p>\n<p>&nbsp;<\/p>\n<p>Joe will become friends with the river keeper. He will have him over for dinner.<\/p>\n<p>&nbsp;<\/p>\n<p>Carrie has not mailed a check. Attorney wanted 2K up front \u2013 check has not been mailed. Problem with mailing check when nobody voted to approve it \u2013 has collected 3K already to go into the fund (Greg, Don, Mike)<\/p>\n<p>Vote for attorney<\/p>\n<p>Motion on floor to retain services LLP<\/p>\n<p>Don got a letter the other day \u2013 looking for a check and contract \u2013 said at anytime we can drop him \u2013 pay original 2K \u2013 will probably take 3 months to get settled \u2013 2K a month<\/p>\n<p>Greg and Joe have been doing legwork \u2013 attorneys could do it but will cost a lot more money<\/p>\n<p>Copies of their commitment letter<\/p>\n<p>&nbsp;<\/p>\n<p>Don said about 5 to 10K total 5K if things go well \u2013 possibility not getting any slips \u2013 could end up exactly where we are right now.<\/p>\n<p>Can bill us in 30 day increments Know what they are going to do before we sign off \u2013 we will be charged for everything \u2013 phone calls, investigation, email, etc.<\/p>\n<p>&nbsp;<\/p>\n<p>Joe said pilings have been here since 1996 \u2013 nobody in our community put the pilings up<\/p>\n<p>&nbsp;<\/p>\n<p>Put new pilings exactly where they are right now \u2013 no problem with doing that \u2013 we can make improvements without a permit but cannot change \u2013 cannot widen it or put in more slips<\/p>\n<p>&nbsp;<\/p>\n<p>If county says they are illegal pilings \u2013 they can make us take out what is there right now.<\/p>\n<p>&nbsp;<\/p>\n<p>Most support attorney \u2013 but can go on and on and still have nothing and spend a bunch of moula.<\/p>\n<p>&nbsp;<\/p>\n<p>Right now there are 3 slips \u2013 has had as many as 4 boats there plus the Crabbin\u2019 Cruiser<\/p>\n<p>&nbsp;<\/p>\n<p>Todd \u2013 owner of Fisherman\u2019s Dock \u2013 said if we wanted to repair the dock and did not do it all at once we can do repair in sections without permit<\/p>\n<p>Cannot do full repair without a permit \u2013 anything over 100 need a permit. Don\u2019t need a variance.<\/p>\n<p>&nbsp;<\/p>\n<p>Will not stop us completely \u2013 just how far we can go.<\/p>\n<p>Guy from zoning told Don we can\u2019t have slip for every house \u2013 11 slips \u2013 ask for the most to get any<\/p>\n<p>&nbsp;<\/p>\n<p>AERIAL photographs are the first step before anything<\/p>\n<p>&nbsp;<\/p>\n<p>Rhode River keeper is paid \u2013 looks for violations \u2013 want to make a do of it because that is what they get paid for (Don)<\/p>\n<p>&nbsp;<\/p>\n<p>Don said pilings on square at end are at least 50 years old.<\/p>\n<p>&nbsp;<\/p>\n<p>Rita \u2013 everyone is worried about throwing money out the window and getting ntohing back<\/p>\n<p>Need a meeting and vote before we can do anything \u2013 tell attorney, and wait until we get aerial photos before we can do anything \u2013 will look at photos on Tuesday<\/p>\n<p>&nbsp;<\/p>\n<p>Meeting on Thursday June 4<sup>th<\/sup> @ home of to put motion on for all in favor of money towards attorney<\/p>\n<p>Do not want to drag on for two more months \u2013 know if there is a commitment<\/p>\n<p>&nbsp;<\/p>\n<p>Don has copies of commitment letter \u2013 distributed and Greg will post on website<\/p>\n<p>&nbsp;<\/p>\n<p>Option of this is the most we can spend a month since he is asking for 2K\/month<\/p>\n<p>&nbsp;<\/p>\n<p>DON: If we do not do anything, we will not get anything!<\/p>\n<p>&nbsp;<\/p>\n<p>Money cutoff? Will not get anything more than 5K \u2013 we have some expectations about what we would like to get out of the 5K \u2013 hold attorney accountable for some milestone<\/p>\n<p>&nbsp;<\/p>\n<p>Variants will not give us any slips<\/p>\n<p>&nbsp;<\/p>\n<p>Original proposal was probably more than we would get \u2013 several options on calculating how many slips up to 15 homes \u2013 one slip for each<\/p>\n<p>Look at the frontage that the community has \u2013 every 50 feet of frontage \u2013 one slip 87 footage only get 1 slip<\/p>\n<p>Only parcel of the pier or looking at the entire community \u2013 he said there are piers there already \u2013 no laws against this though<\/p>\n<p>Frontage is 300 feet \u2013 will get 6 slips<\/p>\n<p>Variance on the 30K square feet<\/p>\n<p>&nbsp;<\/p>\n<p>Are we willing to spend money to get a few slips, or just stay where we are today? Want to have an answer!<\/p>\n<p>&nbsp;<\/p>\n<p>Everyone wants to know if we are just throwing money out of the door.<\/p>\n<p>&nbsp;<\/p>\n<p>Will have motion to write a check after aerial photographs<\/p>\n<p>Mike said he can dial in \u2013 or we can call him<\/p>\n<p>&nbsp;<\/p>\n<p>Check was never cut \u2013 has nothing of ours yet<\/p>\n<p>&nbsp;<\/p>\n<p>Carrie suggested if we do proceed with pier fund we should open another account for that<\/p>\n<p>&nbsp;<\/p>\n<p>Sign \u2013 letters had bolts<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>Bylaws:<\/p>\n<p>10 pages of bylaws sent by John Latuperissa \u2013 he could not attend meeting tonight \u2013 he drafted by looking online and to rewriting it to fit our community. At least 90% is generic and just \u201cRhode Harbor\u201d was inserted.<\/p>\n<p>Part of the bylaws of any community<\/p>\n<p>&nbsp;<\/p>\n<p>Don\u2019t try to do whole thing tonight \u2013 too much (Don)<\/p>\n<p>Attorney said it should be gone through<\/p>\n<p>&nbsp;<\/p>\n<p>The community went through bylaws line by line to make sure they were okay with everything<\/p>\n<p>&nbsp;<\/p>\n<p>First page and a half is rights of HOA\u2019s \u2013 Rita noted it is same rights for HO\u2019s and condo\u2019s \u2013 it says condo in one line instead of home<\/p>\n<p>&nbsp;<\/p>\n<p>Went through first few pages:<\/p>\n<p>No problems with first page except inserting condo owners with home owners<\/p>\n<p>No problems with page 2<\/p>\n<p>No problems with page 3<\/p>\n<p>&nbsp;<\/p>\n<p>Rest will be reviewed by everyone at home and deadline will be made for comments to be considered<\/p>\n<p>Comment period on this draft \u2013 comment meeting on June 10<sup>th<\/sup> and have official June meeting and have final draft, elect officers, and dues on Tuesday June 22 @<\/p>\n<p>Not everyone has reviewed yet even though they were supposed to<\/p>\n<p>&nbsp;<\/p>\n<p>Boat slips for residents of Rhode Harbor.<\/p>\n<p>&nbsp;<\/p>\n<p>Money has gone through safe deposit box, stamps, signs \u2013 probably have not even spent 400 dollars this year (Don)<\/p>\n<p>&nbsp;<\/p>\n<p>Greg read when land is transferred from county back to HOA Earl was being held responsible for any failure of the sewer tanks \u2013 he would be held personally responsible \u2013 not sure if this is correct<\/p>\n<p>Mike said every year the county comes and fixes everything \u2013 county pumps everything out \u2013 septic systems are all managed by the county.
